North County ADU Rules & 2026 Updates

Ministerial review
Qualifying ADUs are reviewed against objective standards without a discretionary hearing. For a lot with an existing home, a complete application generally must be approved or denied within 60 days.
Completeness notice
Beginning in 2026, a permitting agency generally has 15 business days to say whether an ADU or JADU application is complete and explain how to complete it if it is not.
800-square-foot pathway
Local standards may not eliminate the ability to build at least an 800-square-foot ADU with no more than four-foot side and rear setbacks when the project meets the other applicable requirements.
Height varies by setting
The state baseline for certain detached ADUs begins at 16 feet, with 18- or 20-foot allowances in specified transit, roof-pitch and multifamily situations. Attached ADUs have a different framework.
Parking exemptions
Parking cannot be required in several state-defined situations, including certain transit locations and conversions. Coastal and site-specific review can still affect the project.
Impact-fee limits
No impact fee may be imposed on an ADU with 750 square feet or less of interior livable space, or a JADU with 500 square feet or less. Utility connection and capacity charges are a separate subject.
Owner occupancy
State law bars an owner-occupancy requirement for an ADU. For a JADU, the 2026 rule ties owner occupancy to whether sanitation facilities are shared with the primary structure.
Units on multifamily lots
State pathways allow conversions of qualifying non-livable multifamily space and, on a lot with an existing multifamily dwelling, up to eight detached ADUs—capped by the number of existing units.
Existing unpermitted units
Special rules may help legalize an ADU or JADU built before January 1, 2020, subject to health-and-safety and substandard-building limitations.
What changed for 2026
The March 2026 HCD Handbook incorporates legislation effective through January 1, 2026.
15-business-day completeness review
Agencies must identify missing items and describe how an application can be made complete. State law also adds an appeal process for incompleteness determinations and denials.
60-day completed-application decision
State law clarifies the timeline for local government or Coastal Commission action on a completed coastal development permit application for an ADU. A coastal permit may still be required.
Interior livable space controls key thresholds
Size and impact-fee thresholds now expressly use interior livable space. The 2026 framework also clarifies utility, impact-fee and small-unit treatment.
Occupancy and rental rules clarified
Owner occupancy applies when the JADU shares sanitation with the primary home. JADUs may not be used as short-term rentals and, if rented, require terms longer than 30 days.
HCD submission and response deadlines matter
A local ordinance can become null and void when an agency misses specified submission or response deadlines, in which case the agency must apply State ADU Law.
New SB 1077 guidance issued July 2026
The California Coastal Commission published final guidance to help coastal jurisdictions simplify ADU provisions in Local Coastal Programs while retaining Coastal Act review.
